Charges: Fairmont man was over 3x's the legal limit during crash that injured pregnant woman

(Fairmont, MN) – A Fairmont man is facing multiple criminal charges after allegedly causing a multi-vehicle crash that injured a pregnant woman in April.

Seth Michael Kick, 26, was charged Monday with three counts of criminal vehicular operation, and three counts of second-degree DWI, both gross misdemeanors.

According to the criminal complaint, witnesses told investigators Kick’s Hyundai was traveling at speeds of 80-100 mph before the crash at County Road 39 and Lake Avenue in Fairmont.

The driver of a semi involved in the crash told officers he’d been at a stop sign at 190th and 120th Street when Kick’s vehicle rear-ended the car behind him, pushing the vehicle into his trailer. Prior to the crash, Kick allegedly also side-swiped and broke the mirror off a vehicle he’d attempted to pass at high speeds.

The woman driving the vehicle that crashed into the semi’s trailer was 36 weeks pregnant at the time of April 18th crash, according to court documents filed in Martin County Court Monday. She suffered lower back pain and bruising to her arms and lower waist. She was held at the hospital overnight because she was having small contractions, according to the complaint.

Kick was seriously injured in the crash and was flown from the scene with a concussion, multiple broken bones, and a severed tendon in his hand. A draw of his blood at Rochester’s Mayo Clinic put his blood alcohol content at .29, according to the complaint. Court documents say marijuana was also found in his vehicle the day of the crash.

In a later interview with police at his home, Kick said that was a chance he had been drinking the day of the accident because he was off work that day. The crash time was noted as 3:27 p.m. in court documents.

Police say Kick was previously convicted of DWI in March 2013.
