(Le Center, MN) – Charges say a man who left the scene of a crash that gravely injured a Delavan man had smoked pot prior to the collision.

Andrew Paul Holm, 29, of Le Center, was charged with felony criminal vehicular operation in Faribault County Court Monday.

According to the criminal complaint, the Minnesota State Patrol was dispatched just after midnight on July 25th to a crash on Highway 109.  At the scene, they found Tyler Day Neal, 29, of Delevan in the middle of the road with his Harley Davidson laying nearby.

There were no other vehicles at the scene, but tracks led law enforcement to a truck registered to Holm that had been abandoned on County Road 13.  Holm was discovered hiding in a field about 200 yards south of the pickup.

Holm told police that he had not been driving and there had been three other people in the truck with him.  He refused to name them, saying “that’s for you to figure out.”  He admitted he’d smoked marijuana while in the truck, according to the complaint.

A meth pipe, a marijuana grinder, and a blue butane touch was found on Holm during his arrest, according to the complaint.  The keys were also found in his pocket.  Police did not locate anyone else in the area.

The most recent update on Neal had him in fair condition at St. Mary’s Rochester.  His mother told police he had suffered fractures to his head and face, broken ribs, road rash, and had spinal fluid draining into his ear.
